Terms of Service

Last updated

Draft — written to match how Kamping works today, but not yet reviewed by a lawyer. Details in [square brackets] are still to be filled in.

These terms, in short

Kamping is a free directory of places to camp. We publish information contributed by travellers and by the businesses themselves. We do not own, run, inspect or control any of the places listed, and we do not grant anyone permission to camp anywhere. Check before you go, and behave well when you get there.

The rest of this document says the same thing with the detail a contract needs. By using kamping.al or creating an account you agree to it.

Who we are

kamping.al is operated by [COMPANY NAME] sh.p.k., registered in Albania at [REGISTERED ADDRESS], Albania, company number [NIPT / COMPANY NUMBER]. You can reach us at legal@kamping.al.

What Kamping is — and is not

Kamping is an information directory. We list campsites, campervan stops, parking areas, farm stays, guesthouses and camper services such as water and waste points.

Kamping is not a booking service. You cannot reserve or pay for a stay through us, and we are not a party to anything you agree with a site owner.

Kamping is not a landowner, an operator, an inspector, a travel agency, an insurer, or any kind of public authority. We cannot give you permission to be anywhere.

We do not list wild camping

Kamping does not have a wild-camping category and does not publish locations on the basis that you may camp there without permission. Every place in the directory is listed as an established campsite, a designated stop or parking area, a farm stay or guesthouse, or a service point.

Do not submit locations in national parks, nature reserves or other protected areas, or on private land, unless camping there is expressly permitted and you can say by whom. We remove submissions that appear to encourage camping where it is not allowed, and we may remove your account for repeatedly doing so.

Wild camping is regulated differently across Albania and the region and the rules are not always obvious on the ground. Until that is clearer, the answer here is simply that this is not a service we offer.

Free for now

Kamping is free to use for travellers and for businesses throughout the first year of operation. No payment details are collected and no charges apply.

We intend to introduce paid plans for accommodation businesses later. If we do, we will publish the prices and terms in advance, and no existing account will ever be charged without first agreeing to a new paid plan. Continuing to use the free service will never in itself create a payment obligation.

Because the service is free, we may change or withdraw features, and we do not promise uninterrupted availability.

Kamping Manager and our mobile apps

Pages on this site describe Kamping Manager, a product for accommodation businesses, and mobile apps for iOS and Android. These are in development and are not yet available. Descriptions of them are information about our plans, not an offer, and not a promise that any particular feature will ship or ship on any date.

When they become available they will have their own terms, which you will be asked to accept separately.

Your account

You must be at least 16 to create an account. Give accurate information, keep your password to yourself, and tell us if you think someone else has got into your account.

One person, one account. Do not create accounts to evade a suspension, to inflate ratings, or to pose as somebody else.

You can delete your account at any time from your dashboard.

What you may and may not post

You may post information about places you have actually been, photographs you took yourself, and honest opinions about your own experience.

You may not post: anything unlawful; other people’s photographs or text without their permission; personal data about other people, including identifiable faces or vehicle number plates, without their agreement; anything defamatory, hateful, harassing or threatening; advertising or spam; or locations where camping is not permitted.

We can remove any content, at any time, without notice, if we think it breaks these rules or puts us or anybody else at risk. We are not obliged to monitor everything that is posted, and we do not claim to.

Rights in what you post

You keep ownership of everything you submit. You give us a worldwide, non-exclusive, royalty-free licence to host, store, resize, display and distribute it as part of the service, and to show it in material promoting Kamping.

That licence lasts while your content is published. If you delete a photograph or a review, the licence ends for that item, except for copies already made in backups or already used in printed or published promotional material.

You confirm that you own what you submit, or have permission to submit it, and that publishing it does not break anybody else’s rights.

Reviews

Reviews on Kamping are written by account holders. We do not verify that every reviewer actually stayed at the place they are reviewing, and we say so here so that nobody is misled about it.

We do not accept payment to publish, hide, reorder or delete a review. A business paying for any future plan will never be able to buy the removal of a genuine review.

We remove reviews that break the content rules above. A business that believes a review is false can contact us; where a review is disputed rather than plainly in breach, we will normally offer the business a right of reply rather than delete it.

Businesses and claimed listings

If you claim a listing as its owner or manager you confirm you are authorised to act for that business. We may ask for evidence and may refuse or reverse a claim.

You are responsible for the accuracy of what you publish on your listing — prices, opening periods, facilities and permissions included. Keep it current.

A claimed listing does not become your property. It stays part of the directory, and we may continue to publish community reviews and photographs of it.

Reporting a problem

If something on Kamping is unlawful, infringes your rights, or is simply wrong, tell us at legal@kamping.al with a link, what the problem is, and how we can reach you. If you are reporting an intellectual-property infringement, tell us what you own and confirm you are entitled to complain.

We aim to acknowledge reports within 5 working days and to act on clear cases promptly. We will tell the person who posted the content that it was removed and why, unless we are legally prevented.

Your responsibility when you travel

Information on Kamping comes from other people and may be out of date, incomplete or simply wrong. Verify anything that matters before you rely on it.

You are responsible for checking that you are permitted to be where you are going; for judging whether your vehicle can safely reach and leave a place; for local rules, signage, fire restrictions and seasonal closures; and for your own safety and that of anybody travelling with you.

Nothing on this site is advice to enter, park, camp on or use any location. Access notes, prices, opening periods and status labels describe what was reported to us, not what is guaranteed to be true when you arrive.

What we are not liable for

The service is provided as it is. To the fullest extent the law allows, we exclude implied warranties about accuracy, availability and fitness for a particular purpose.

We are not liable for loss, damage, injury, fines or costs arising from: information published by other users; the acts or omissions of any site owner or third party; your inability to access a place, or the conditions you find there; or interruptions to the service.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Where we are liable, and to the extent the law allows, our total liability to you is limited to EUR 100, reflecting that the service is provided free of charge.

If you are a consumer, you keep all rights that Albanian consumer law — and, where it applies to you, the consumer law of your own country — gives you regardless of what this document says.

Suspending or ending your access

We may suspend or close an account that breaks these terms, that we reasonably believe is being used unlawfully, or that puts other users at risk. Where it is reasonable to do so we will tell you why and give you a chance to respond.

You can stop using Kamping and delete your account whenever you like.

Changes

We may change these terms as the service changes. The date at the top shows the current version. If a change matters — a new charge, a reduction in your rights — we will tell account holders by email before it takes effect, and you can close your account if you do not accept it.

Law and disputes

These terms are governed by the law of the Republic of Albania, and the courts of [CITY], Albania have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory rules of your own country.

The English version of these terms is the operative one. Versions in Albanian, Italian and German are provided for convenience; if they differ, the English text governs.
